In 2011 the assault case was sent to the Criminal Cases Review Commission (CCRC), an organisation set up by Parliament to examine miscarriages of justice. As one of Mr McArthur's accusers was an ex-partner he tried to warn her in a series of emails that the truth would come out and that it would look better if she helped him. Mr McArthur was then charged with harassment even though the emails were carefully written and contained nothing offensive.

The problem was that one of the emails contained a reference to the CCRC application so the police contacted the CCRC and got them to rush the case through in time for the trial. The Commissioner who examined the case, Ian Nichol didn't see the emails and assumed Mr McArthur was just harassing a victim of crime and to help the police ignored the evidence and rejected the application. What followed was farce, but farce that resulted in a wrongful imprisonment. To see what happened read the document marked 'The Trial'.
